Ukraine issues notification concerning the application of the New York Convention on parts of its territory
(i) That due to the Russian Federation’s occupation of the Autonomous Republic of Crimea and the city of Sevastopol and due to the Russian Federation’s effective control over certain districts of the Donetsk and Luhansk oblasts, Ukraine’s application of the New York Convention to these territories is limited and not guaranteed;
(ii) That documents or requests made or issued by the occupying authorities of the Russian Federation at the aforementioned territories are null and void and have no legal effect regardless of whether they are presented directly or indirectly through the authorities of the Russian Federation; and,
(iii) That the provisions of the New York Convention regarding the possibility of direct communication or interaction do not apply to organs of Ukraine in the aforementioned territories, the procedure for the relevant communications being determined by the central authorities of Ukraine in Kyiv.
The Ukrainian Ministry of Foreign Affairs then requested that the Secretary-General circulate the notification to the States parties to the New York Convention.
The Secretary-General issued Ukraine’s notification on 11 November 2015.
