The Website is a free service provided by the “1958 New York Convention Guide”, a project realized by Shearman & Sterling LLP in conjunction with Columbia Law School and with the support of UNCITRAL (United Nations Commission on International Trade Law), and relating to the interpretation and application of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, 1958 (New York) (“New York Convention”). Access to the Website is anonymous. Therefore, the Website does not collect the personal data of a user who consults the Website.
The case law contained on the Website may include personal data. The capture and use of personal data appearing on the Website, for instance for commercial or advertising purposes, are strictly prohibited.
In accordance with French Law No. 78-17 of 6 January 1978 “Informatique et Libertés”, any individuals whose personal data appears in the case law included in Website have a right to oppose (Article 38), access (Article 39) and rectify (Article 40) such personal data. In addition, all logos and trademarks contained on the Website constitute trademarks (semi-figurative or otherwise) which have been reserved. Any reproduction, use or alteration of the trademarks or logos, in any manner or for whatever purpose, is prohibited pursuant to Article L. 713-2 of the French Intellectual Property Code.

Original language decisions attached to the English summaries of case law contained on the Website are publicly-accessible decisions which are part of public domain. However, with the exception of decisions which have been collected from court registries or which are available on the public websites of such courts (or on other public websites), and which do not contain restrictions preventing their use or reproduction on the Website, the uploading of decisions provided by institutions or organizations has been duly authorized by these institutions and organizations listed as “Contributors”. Le nom de domaine « newyorkconvention1958.org », ainsi que tout autre nom de domaine ou sous-domaine associés au projet « 1958 New York Convention Guide », constituent des droits protégés. Par ailleurs, tous les logos et marques figurant sur le Site constituent des marques (semi-figuratives ou non) qui ont été déposées. L’utilisateur peut toutefois imprimer, télécharger et/ou conserver temporairement une copie des résumés en langue anglaise des décisions de justice, ainsi que des traductions non officielles de ces décisions, pour son usage personnel et non commercial, conformément à la réglementation française relative à l’exception de copie privée (article L. 122-5 du Code de la propriété intellectuelle).
Enfin, les décisions de justice en langue originale jointes aux résumés en langue anglaise figurant sur le Site sont des décisions publiques relevant du domaine public. Toutefois, à l’exception des décisions qui proviennent directement des greffes des juridictions nationales concernées ou des sites internet desdites juridictions (ou autres sites publics) qui ne comporteraient pas de restrictions interdisant l’usage et la reproduction de ces décisions sur le Site, la mise en ligne des décisions provenant de diverses institutions ou organisations a été rendue possible par l’autorisation obtenue auprès de ces institutions et organisations figurant dans la liste des Contributeurs. L’autorisation de reproduction et de diffusion vaut uniquement pour le Site et ne saurait conférer aucun droit à l’égard de tiers, utilisateurs du Site.
