Domestic Court with jurisdiction over recognition and enforcement of foreign award |
For the recognition of foreign awards, the ordinary court at the place at which the party wants the effects of the award to be recognized (Articles 540 and 543 of the CGP). For the enforcement of duly recognized foreign awards, a preliminary exequatur procedure must be filed with the Supreme Court of Justice. Once this procedure is completed, the award must be forwarded to the ordinary court of first instance with jurisdiction under internal court rules for it to proceed with enforcement (Articles 541 and 543 of the CGP). |
