(“White Bear”) and Jiangdu Yahai Shipbuilding Co., Ltd. (“Yahai”) entered into an agreement where White Bear commissioned the building of a tanker from Yahai. Yahai failed to deliver the tanker in accordance with the parties’ agreement and White Bear filed for arbitration in London. The arbitration was presided by a sole arbitrator who rendered an arbitral award in favour of White Bear. On 6 April 2006, White Bear applied for recognition and enforcement of the award before the Wuhan Maritime Court (武汉海事法院). Yahai did not file any objections to the application within the designated period. The Wuhan Maritime court opined that the arbitral award should be recognised and enforced. In particular, the court observed that the parties’ shipbuilding agreement was a contractual commercial relationship under Chinese law. Furthermore, the court found that the NYC was applicable to the examination of the application for recognition and enforcement since the United Kingdom and China are both Contracting Parties to the NYC. The court also determined that there were no grounds for refusing recognition or enforcement of the arbitral award under Article V NYC.
