In particular, the parties requested a ruling on the question whether the arbitral clause could be enforced notwithstanding s 11 of the Carriage of Goods by Sea Act 1991 (Cth) (“COGSA”), insofar as the charterparty could be construed as a “sea carriage document” within the meaning of s 11(1)(a) of COGSA, the purpose of which was to preclude or limit the jurisdiction of Australian courts, as prohibited by s 11(2) of COGSA. The Court held that the questions should be answered in the affirmative. In so ruling, it found that the charterparty was an “agreement in writing” of the kind referred to in Article II(1) NYC. see also :
