Jiangsu Provincial Foreign Trade Corporation Case number (2008) Ning Min Wu Chu Zi No. 43 ([2008]宁民五初字第43号) Applicable NYC Provisions V | V(1)(a) Languages English Summary On 25 and 26 August 2004, U.S. VOEST-ALPINE International Trade Company and Jiangsu Provincial Foreign Trade Corporation entered into negotiations for the sale of goods. A dispute arose and U.S. VOEST-ALPINE International Trade Company filed an arbitration with the Singapore International Arbitration Centre where the seat of arbitration was Singapore. On 15 October 2007, an award was rendered in favour of U.S. VOEST-ALPINE International Trade Company, who then applied on 28 May 2008 for recognition and enforcement of the award with the Nanjing Intermediate People's Court (南京市中级人民法院). The Nanjing Intermediate People's Court opined that the award should not be recognised or enforced. In particular, the court opined, with reference to Article V(1)(a) NYC, that the parties had not validly reached an agreement under the applicable law, Singaporean law.
